Middle East. 2014-12.
Through this exploratory article, Muftah (2014) lays emphasis on aspects of marriages, relationships, and family. The application of scholarly and applicable approaches with themes relevant to global environments improves the relevance of the article on the prospect of choices in the diverse society. The author offers insightful perspectives regarding the existing diversity and cultures in the modern society, which is inclusive of differential ethnicity, familial forms, and traditions.
The issue of legality of same-sex marriages has been a characteristic of numerous policy constraints that have been uneasy to navigate. In this sense, Muftah (2014) claims that laws and regulatory framework governing same-sex marriages, domestic partnerships, and civil unions vary from state to state thus resulting to the emergence of federal conflicts. Understanding the various formalities as generated by the author through the article necessitates the development of a concise position regarding the legal nature of LBGT from a global perspective.
Sithole, S. (2015) Challenges faced by gay, lesbian, bisexual and transgender
(LBGT) Students at a South African university. the Journal for Trans disciplinary Research in Southern Africa, 11, 4, 193-219.
The article seeks to provide an analysis of the numerous social and academic challenges experienced by gay, bisexual, lesbian, and transgender students in a South African University. The data collected is from a qualitative study. After an analysis of the data collected from the LGBT community on campus, Sithole (2015) insinuates that students grapple with discrimination issues such as sexual abuse, labelling, marginalization, unfairness etc. This aspects affecting the LGBT student population is a representation of the cancerous societal ills. The article presents explicit measures and practices like promoting social justice, which would facilitate the realization of antidiscrimination of the LGBT community.
Summary
The perspective behind the illegalization of gay marriages has its basis on the existing infringement associating with religious freedom. Expounding on this issue Friedman (2016) reiterates that civil and religious marriages are distinct institutions such that criminalizing gay and other types of LBGT marriages is characteristic of the fact that homosexuality and lesbianism is sinful. Nonetheless, the constitution disagrees with this aspect as it clearly facilitates the provision of protections to all American citizens irrespective of their religious or cultural background. In this sense, the state and other federal government agencies perceive marriages as secular actions hence the government is mandated to overcome the various religious influences. As such, they should ensure the enactment of laws and policies that guarantee the respect of constitutional rights of all persons.
Taking a supportive point of view on the legalization of gay marriages, it is my understanding that Gays are liable to the right of choosing their spouse and partner. The law and other regulatory bodies ought to extend equality rights for same-sex couples to ensure the elimination of antidiscrimination issues as well as the existing societal prejudices that emanate mainly due to condemnation by various religious bodies. Exemplified by the scholar Dudley (Barker and Monk, 2015), the legalization of gay marriages in the various global societies is subject to promote family values and social stability. Therefore, it is my view that gay and other forms of LGBT marriages should have constitutional recognition and protection as the participants have equal rights to choose their lifestyle regardless of how the society’s perception.
