The duty to warn is an exception to the client-counselor confidentiality laws. The counselors do not need the consent of their clients to reveal the information to the people that will be affected. However, counselors have to be very careful in differentiating the credibility of the threats from their clients before telling the people that will be affected. In addition, it is hard for the counselors to administer the duty to warn if they do not know the victims of the threats. The counselors are not required to discuss the other sessions of the treatment to the victims.

The first and most important step before treating a child under ten is to see court papers regarding who has custody of this child. Legal custody is where both parents are awarded joint custody. They are involved in the decision making of their children’s needs and have equal rights to the medical and educational records. However, if the two parents do not agree on the decision-making, one of the parents who has the primary physical custody is given the mandate. The importance of awarding a joint legal custody is to allow both parents to make the decision-making regarding any significant issues involving the children. On the other hand, physical custody is given to one of the parents and is determined by many factors. The parent given the primary physical custody is required to be the primary caregiver and live with the children (Maccoby, Depner & Mnookin, 2014). The other parent is given a secondary physical custody where they can visit the child at specific times.
