man as he had since passed away. If we didn’t have technicalities about what evidence was admissible the confession and “hearsay” could all be admissible to the judge’s discretion. Completely changing the legal system we have today.

“The entire legal system requires that we all be judged by the same rules and by the same standards”. We cannot be changing the rules of law to meet individual case regardless of how we feel about it. The moment we do that we lose our freedom, we could allow evidence to be permitted in exceptional circumstances only. However who defines exceptional circumstances and when can it be applied? “If there is freedom not to apply it, it is no longer a rule. It is at best a suggestion that can be rejected by the police or the judge because of their own tastes” If we start allowing inadmissible evidence to be admissible why shouldn’t police abuse their power in order to get more evidence. What’s to stop police from doing whatever it takes short of torture to get the suspect to talk. Without rules in law such as courts refusing involuntary confessions as evidence. Police could make the most innocent of men look guilty.

Technicalities may sometimes seem like a coin toss, on one side they can be a nightmare to society allowing guilty criminals to walk free. But on the other side they protect the very rights and freedom of the citizens of this great country. We need rules and guidelines for police to have to follow without them sure more people would be convicted but that may not just mean more guilty people convicted. In a perfect world technicalities would only be there to protect the innocent and they would be followed by everyone. However in a perfect world there wouldn’t be any crime so we wouldn’t need police. The problem isn’t with technicalities it’s with human error. Criminals get let free because of police officers failing to correctly do their job there isn’t any technicalities like a get out of jail free card this isn’t monopoly. I wouldn’t change anything about our legal system today, the system itself isn’t the problem. It’s run by an imperfect species and therefore it can never be perfect.
