instigate an initiative to the school board for re-considering their ability for realization of the work obligations via threshing of evaluation of the employee’s characteristic for eligibility for work with children and adolescent in the educational activity (personality test).

Bureau for educational development, Parent’s Council and State Educational Inspection instigate the initiative from paragraph 1 of this article to the school board and for teachers in the public high schools which thresh preparations to the students who attend teaching in the school, during and after the working hours in the school, without previously obtained permission from the school board.

The initiative from paragraph 1 and 2 of this article have to contain explanation of the reasons because of which it is instigated.

If the initiative is accepted from paragraphs 1 and 2 of this article the school board bring a proposal to the director for termination of employment of the persons from paragraph 1 and 2 of this article.

The director owe to act upon the proposal of paragraph (4) of this article within sven-days from the day of obtaining the proposal.

Against the act of the director of paragraph 5 of this article the teacher and the qualified associate could abide a complain to the competent court.

Article 70-a

(1) Base on the results of the external evaluation for realization of the students achievement is valued the objectivity and the professionalism of the teacher in the evaluation for realization of the students.

(2) The estimation from paragraph (1) of this article is threshed by comparing the results of the external evaluation for realization of the student with annual grade of the student over the corresponding subject which the National examinations center set a collective report with results of the accomplished external evaluation for realization of the students achievements.

(3) The report from paragraph (2) of this article is set based on the average expressed in per cents from the results of the external evaluation for realization of the students with the annual grades of the students of whom there is not a deviation and of whom the deviation is bigger than one grade.

(4) By exception, the report from paragraph (2) of this article is extended with the teachers who have deviation from the obtained indicators as the last teacher on the list.

(5) The percentage of the biggest deviations from the obtained indicators is 100%, when there is deviation of four grades from the grade obtained of the evaluation and the annual grade of the teacher.

(6) The percentage of the smallest deviations from the obtained indicators is 0%, when there is not a deviation from the grade obtained of the evaluation and the annual grade of the teacher.

(7) Based on the report with results of the accomplished external evaluation for realization of the students, 20% of the teachers where there is smallest deviations from the obtained indicators, their salary increases in the following year for 15% of the salary they received.

(8) Based on the report with results of the accomplished external evaluation for realization of the students, 20% of the teachers where there is biggest deviations from the obtained indicators, their salary decreases in the following year for 15% of the salary they received.

(9) The report with results of the accomplished external evaluation for realization of the students is announced by the National Examination Center on its web-site and on the Ministry no later than 10 August in the current year.

(10) For the teachers of paragraph (8) of this article is procured adequate professional consultative help from the Bureau and the Vocational and Educational Training Centre.

(11) For the teacher who even after two years of obtaining the professional help will once more be in the group of teachers where there is biggest deviations in the obtained indicators, his employment stops.

(12) A decision for termination of teacher’s employment brings the director of the primary school.

(13) Against the decision of the director of paragraph (12) of this article the teacher could submit a complaint to the competent court.

(14) A decision for teacher’s salary increase or decrease according to paragraphs (7) and (8) of this article, brings the school director. Payment of the increased salary, or decreased starts on 1 January the following year after announcing the report for teacher’s working.
