Older people have more traditional views of woman that makes them seem family oriented and serve without having their own actions which gives those working in the system some of the views because of how the juries are set up. So when men commit the crimes, the crimes appear worse when the factors of the views from men are taken into account.
Women generally have a higher probability of claiming to be victims of abuse and despair. Nancy seamen were successfully able to get out of the death penalty by claiming self defense. Nancy had claimed Battered Woman Syndrome (BWS) BWS is a set of symptoms , injuries , and signs of mistreatment seen in woman who have been repeatedly abused by a spouse, partner or relative, a syndrome many woman claim when faced with a life or death situation. Although it has been proven that “Woman are more likely to claim self defense because they are seen as weak and inferior compared to men“ (Warder 2014) . Susan had an emotional past which gave the appearance that she was fragile, this altered her appearance in the court room and made what seem to be a violent act that deserved the death penalty not as bad of an act because the emotional background gave her the appearance that she was “fragile” and “unstable”. These claims and emotional backgrounds give women leverage in a court room.
Although many agree the death penalty is biased against women. According to The American Civil Liberties union “The number of women on death row is small and hence is too difficult to draw any statistical conclusions about gender bias”. ACLU believes there isn’t enough information to back the idea that the death penalty could be bias in favor of woman because the court rooms and the number sentenced is supposedly equal. Even though if a man and a woman commit the same crime men are more likely to receive the death penalty the accuracy in this is unlikely according to ACLU and Justice Marshal agreed with this statement saying “there is also over whelming evidence that the death penalty is employed against men and not woman. It is difficult to understand why woman have received such favored treatment since the purpose allegedly served by capital punishment seemingly are equally applicable to both sexes” Justice Marshal believes that it is also unfair on the part or men because the punishment should be applicable for both sexes but because they are supposed to have equal rights on trial and in the court room. He believes that woman receive special treatment in the trial, conviction and the final sentencing of woman. Woman are often less likely to have a sentence that is more than life in jail rather than death. They are convicted with a punishment but usually is dropped after heavy convincing and the death penalty is often lifted of woman.
The relationship between gender and the death penalty is generally seen as biased in favor of women because women are viewed as inferior when committing a crime, are using self defense, and have committed less murders than men. Although women and men have an unfair advantage in the court room and aren’t as likely to have sympathy on their side when being convicted of a crime in America. The death penalty is bias in favor of woman although can be proven through multiple cases and points, it has not generally been assessed to make the gender role in the death penalty equal in the United States.
