Agreement for Residential Contractor Services
This Agreement for Residential Contractor Services ("Agreement") is entered into by and between the undersigned Contractor (referred to as "Contractor") and Jar Works LLC (“Jar Works” or "Company,” together with Contractor, the “Parties”).
A. WHEREAS Company wishes to engage Contractor to provide certain residential renovation services to Company; and
B. WHEREAS Contractor is willing to provide such services to Company under the conditions agreed to herein;
NOW, THEREFORE, in consideration of the foregoing and the mutual consideration exchanged between Company and Contractor in their continuing relationship, and the mutual promises contained herein, the Parties agree that such consideration is sufficient to bind the Parties to this Agreement; and the Parties further agree as follows.
1. Requests for Permit Applications. When Company desires a building permit for a property owned by Company or an affiliated company, it will request permission from Contractor to apply for such a permit in Contractor’s name with the applicable permitting authority. (Affiliated companies currently include Jar House, LLC; Najarian Capital LLC; and Najarian Holdings LLC.) Such requests shall be emails from Zareh Najarian, Andrew Quisenberry, Ronald Smith or the delegate or any of them. Each such request shall identify the property. The subject line of each new request shall include the words “Permit Application Requested” and shall show at least the street address of the property.
2. Responses to Permit Application Requests. Contractor will grant or deny permission to Company to apply for such permit on Contractor’s behalf within four business hours (business hours being from 8 a.m. to 5 p.m., Eastern Time on weekdays that are neither a Georgia state holiday or a federal holiday). If Contractor can neither grant or deny such permission because the application is deemed inadequate or incomplete, then such advice shall be rendered within four business hours of Company’s request.
3. Responses to Requests of Authorities. Contractor agrees to respond timely to written requests from building authorities and permitting authorities for information or certifications for any property that is the subject of a permit granted to Contractor. Contractor agrees to exercise his best efforts to meet with building authorities and inspectors on site or at the authority’s offices where such a meeting is requested by the building or permitting authority.
4. Fees, Invoices. Company shall pay Contractor $600 for each property for which one or more permits are granted to Contractor for a Company property. All invoices submitted by Contractor shall be paid within ten business days.
