2. In this case, the U.S. Court of Appeals for the Second Circuit said: “It has long been accepted that one cannot support a claim of self-defense by a self-generated necessity to kill.” What is the logic behind this principle? Do you agree with it? Explain?

The logic behind this principle is, if you instigate your own problem, it was not a defense, it was a reacting from how your intended victim responded to your aggression. I do agree with this principle for the simple fact of you lay in the bed you made. If you are not ready for the possible circumstances, then don’t commit the crime.

3. Under what circumstances, if any, might the defendant have been justified in using force against Agent Howard? Under what circumstances might they have been justified in using deadly force?

Under the circumstances, and not changing any of the details, I do not think that the defendant could be justified in using force against Agent Howard because he was already planning to commit an additional crime on top of the ones he had already committed. One way I can see the defendant being justified in using deadly force against Agent Howard, is if Lawrence and his partner had not had their guns drawn and Agent Howard jumped out of the car and just started shooting.

Discussion

This week, as of all past weeks, was interesting. I wonder how you come up with the topics. I favorite was the self-defense posting. We are a gun loving family. We carry and have guns pretty much everywhere in our home, secured of course. We teach our children about gun safety and want them to be comfortable but also understand the consequences when you shoot a gun. The animal neglect discussion makes my stomach turn because we love our fur babies as much as we love our children and anyone causing harm to them would make me very angry and very hurt.

Class Activity

I just finished the quiz and it was great. I really felt that I was able to understand these chapters more. Maybe because it had to do with defense. I think doing the journal, even if they do take a while to do, help with the understanding of what we’ve read. The applying the concepts were not as rough as last weeks. I am thankful for that, because last week gave me nightmares.

Conclusion

This was a good week. I felt like I had a little more control than I have in the past couple of weeks. I was able to spread my work out and really dive in, verse playing catch up and rushing to get everything done on time. I guess that was my success this week. I am getting better with my time management between the three classes, work and children activities. So this week was a great week.
